Under section 230 of the Maritime Transport Act 1994 (the Act) and Part 103 of the Marine Protection Rules (MPRs), notification of oil transfers must be given to Environment Southland not less than 3 hours (but not more than 96 hours) prior to the transfer taking place. Under section 227 of the Act and Part 130B of the MPRs, spillage of oil into the sea must be reported to Environment Southland or Maritime New Zealand. Discharge of oil into the coastal marine area is an offence under the Resource Management Act 1991 and is subject to a maximum fine of NZ $600,000 and the recovery of costs of oil removal and clean up. (See sections 15B, 338 and 339.)
